We provide telehealth services using Zoom, and communicate with patients via Zoom’s phone and text features. These services allow you to consult with our healthcare providers and communicate with our staff remotely through interactive audio, video, electronic communication methods, phone calls, and text messages.
3. Consent to Telehealth and Communication
By participating in telehealth sessions and using our phone or text communication services, you consent to these services in accordance with the statutes and regulations outlined by the Board of Behavioral Health Examiners. Participation in these services is voluntary, and you have the right to refuse or withdraw consent at any time.
4. Use of Zoom
You agree to use Zoom solely for the purpose of participating in telehealth sessions and communicating with our staff. You must ensure that your use of Zoom complies with all applicable laws and regulations.
5. Recording of Sessions
Telehealth sessions may be recorded for clinical and quality assurance purposes, but only with your explicit consent. Recordings will be securely stored and only accessible to authorized personnel, in compliance with HIPAA regulations, ensuring the confidentiality, integrity, and availability of your personal health information.
6. Patient Responsibilities
As a patient, you are responsible for:
- Providing accurate and complete information about your health.
- Participating in the telehealth session from a private, secure location.
- Using a secure and stable internet connection.
- Ensuring your technology is compatible with Zoom and functioning properly.
7. Limitations of Telehealth and Communication Services
Telehealth and communication services have certain limitations compared to in-person visits. These may include the lack of physical examination and the potential for technical issues. You acknowledge these limitations and agree to proceed with telehealth sessions and communication services despite them.
8. Technology Failures
In the event of technology failures, we have backup systems in place to mitigate the impact. Our staff is trained to troubleshoot technical issues promptly. Efforts will be made to reconnect or reschedule sessions as soon as possible.
9. Emergency Procedures
You have been informed of the emergency procedures in place, including guidelines for contacting emergency services or local healthcare providers during telehealth sessions. It is important to maintain up-to-date emergency contact information.
10. Identity Verification
We may employ additional verification procedures to confirm your identity during telehealth sessions, phone calls, and text messages, ensuring the security and accuracy of the sessions.
11. Termination of Services
We reserve the right to terminate or suspend telehealth and communication services if you violate these Terms of Service or if we determine that these services are no longer appropriate for your care.
12. Liability Disclaimer
Summit Behavioral Health of AZ LLC DBA Granite Mountain Behavioral Healthcare is not liable for any technical failures, interruptions in service, or any adverse outcomes resulting from the use of telehealth and communication services. While we strive to provide high-quality services, telehealth and communication services have inherent limitations and are not substitutes for all in-person medical consultations.
13. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of the State of Arizona. Any disputes arising from the use of our telehealth and communication services shall be resolved in the courts located in Yavapai, Arizona.
